Axis Media (the "Agency", "we" or "us") agrees to provide website design, graphic design, logo design and hosting services to you, subject to the following terms and conditions of service.. By placing an order or accessing services with Axis Media, you confirm that you are in agreement with and bound by the terms and conditions below.
Axis Media will carry out work only for clients who are 18 years of age or above. An ‘order’ is deemed to be a written or verbal contract between Axis Media and the client, this includes telephone and email agreements.
Axis Media reserve the right to refuse its service(s) to anyone. All services provided by Axis Media may only be used for lawful purposes.
Axis Media reserves the right to make changes to this Terms of Services with or without informing the client. All new Terms of service shall supersede the previous Terms of service.
Axis Media cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.
The website, graphics and any programming code remain the property of Axis Media until all outstanding accounts are paid in full.
Axis Media cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
The client agrees to make available as soon as is reasonably possible to Axis Media all materials required to complete the site to the agreed standard and within the set deadline. Axis Media will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
The rights to photographs, graphics and any third party items such as source code, always remain the property of their respective owners.
As all the text inputs are the responsibility of the client, Axis Media shall not be responsible for any spelling or grammatical errors in the contents of the website.
The Client would give the FTP access & other relevant accesses required to maintain the site. If there is an element of Flash or any other programming/coded element in the website, the client would give the source code of the same. All inputs for maintaining the website shall be provided by the Client.
Completed Tasks would be uploaded on to a test site and approval from the client side. Only TWO corrections/changes would be allowed once the task is uploaded on to the test site. Axis Media would treat all other corrections as an update and charge accordingly. All corrections/changes made after the task is put on the main site, would be treated as a new update only. Axis Media would upload the data to the main site only after receiving the approval from client via email.
If the website is not hosted, Axis Media would not responsible for the proper functioning of the hosting server or any of the associated servers and is not responsible for any delay of services from the hosting company.
A deposit of 50% is required with any project before any design work will be carried out.
Once a website has been designed and completed the final balance of payment needs to be done. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary.
A deposit is required from any new client before any work is carried out. It is the Axis Media policy that any outstanding accounts for work carried out by Axis Media or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Axis Media.
Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. We will contact clients via email or telephone to remind them of such payments if they are not received when due.
Either Customer or Axis Media may terminate or cancel Customer's Account (or any part of the Service) at any time, but Axis Media will not refund any prepaid fees upon such termination or cancellation.
Axis Media will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. Axis Media will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents. Axis Media will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.
We have a zero tolerance policy for posting negative feedback on any public locations about our company and/or our employees before submitting a ticket to our Suggestions and Complaints Department to discuss your issue, this will result in immediate account termination without any refund.
Although it is your right to post feedback without discussing your issue with us first, it is undoubtedly unfair and unprofessional not to, which is not the type of client that we want to deal with. We have the utmost respect for all of our clients, and are more than fair with all of our clients. We will do anything and everything possible to keep all of our clients satisfied. But in the unlikely event you are not satisfied, all that we ask is to discuss your issue with our Complaints Department first. For example, if you are the type of person to run to the forums at the first chance you get to complain, please DO NOT SIGNUP with Axis Media in the first place.
